Gwenaëlle Artur and César Solis comment on the decree n°2022-1284 regarding the procedures for the collection and processing of whistleblowers’ reports introduced by law n° 2022-401 of March 21, 2022 aiming at improving the protection of whistleblowers, which has been published in the French Journal Officiel (JO) on October 3rd, 2022, and comes into force today, October 4, 2022.
In particular, this decree sets out :
- The deadlines applicable within the framework of the internal whistleblowing procedure (including acknowledgement of receipt of the alert and information to the author of the alert on the measures proposed or taken to assess the accuracy of the allegations and to remedy them, where necessary) (Chapter 1 of the decree);
- Procedure for the collection and processing of alerts by the external authorities and list of external authorities instituted by law n° 2022-401 of March 21, 2022 likely to receive an external alert (Chapter II of the Decree and Annex to the Decree).
