
The IP-IT & Data team assists its clients, companies and managers, creators and inventors, in developing their projects and defending their interests in intellectual property law, digital law and the protection of personal data.
Enhancing the value of all intangible assets:
- Copyright and related rights, trademarks, designs and models, patents, domain names, etc.
Management of the portfolio of intangible assets:
- Consultations, prior art searches, risk analyses, filings and renewals, proposals for asset protection strategies
Contractualisation of rights:
- Negotiation and drafting of contracts (assignment, licence, coexistence, publishing, partnership, etc.)
Litigation management:
- Handling of oppositions before the offices, representation before the civil and criminal courts (e.g. counterfeiting, infringement of the rights of database producers, implementation and monitoring of reports, seizures against counterfeiters, etc.) seizures and forensic examinations
Negotiation and drafting of IT contracts:
- Licences and assignment of rights, maintenance, SaaS, PaaS, ASP, subcontracting or outsourcing, hosting, website design and development, contractual documentation for information systems management, etc.
- Online advertising: analysis and supervision of relations with third parties for the management of cookies, online advertising and the sharing of customer data
Compliance audits and support in the design and development of projects involving:
- Websites, marketplaces, AI solutions and connected objects, cryptology, cybersecurity, etc.
- E-reputation: advice and management of solutions to be implemented, removal of illegal content published online
Litigation management:
- analysis of legal exit solutions in the event of difficulties with IT projects, support in the pre-litigation, summary proceedings and emergency phases, in B2B and B2C relations, unfair competition and defamation
Assisting DPOs, business divisions and their teams in complying with the RGPD:
- Assistance in analysing the data processing implemented by their organisations, preparing action plans for new projects, negotiating and regularising contracts with subcontractors, joint managers and partners, particularly for customers processing sensitive data, and drafting the mandatory RGPD documentation
RGPD audit and recommendation:
- Relating to internal IS, mobile applications and connected objects intended for users in France and abroad
Assistance with internal investigations, inspections by the CNIL and other supervisory authorities (e.g. DDPP):
Feasibility studies for innovative projects involving sensitive personal data (health data, biometric data, facial recognition) in France and abroad
Training and awareness-raising:
- On the protection of personal data and compliance with the RGPD
